Demokrasi Di Indonesia Berkaitan Dengan Rule Of Law

BAB 1

PENDAHULUAN

Rule of law adalah istilah dari tradisi common law dan berbeda dengan persamaannya dalam tradisi hukum Kontinental, yaitu Rechtsstaat (negara yang diatur oleh hukum). Keduanya memerlukan prosedur yang adil (procedural fairness), due process dan persamaan di depan hukum, tetapi rule of law juga sering dianggap memerlukan pemisahan kekuasaan, perlindungan hak asasi manusia tertentu dan demokratisasi. Baru-baru ini, rule of law dan negara hukum semakin mirip dan perbedaan di antara kedua konsep tersebut menjadi semakin kurang tajam.

Rule of law tumbuh dan berkembang pertama kali pada negara-negara yang menganut system seperti Inggris dan Amerika Serikat, kedua negara tersebut mengejewantahkannya sebagai perwujudan dari persamaan hak, kewajiban, dan derajat dalam suatu negara di hadapan hukum. Hal tersebut berlandaskan pada nilai-nilai hak asasi manusia (HAM), di mana setiap warga negara dianggap sama di hadapan hukum dan berhak dijamin HAM-nya melalui sistem hukum dalam negara tersebut.
